What does our DIY Consent Order service cover?
A Consent order (sometimes known as a clean break order) is the only way divorced parties can ensure that any agreement reached by the parties is enforceable in law and that no further claims can be made against the other after the divorce has been made absolute.
Why would I need one?
The divorce itself only deal with the dissolution of the marriage and not your finances. In order to make sure that neither of you can come back to the court , it is best to put the terms of your agreement into a binding court order which dismisses any future claims.
*Court fees may be payable of £45. You may be exempt if you have a low income or are on benefits.
DIY Consent Order Service Requirements
Both parties must agree and sign the order. When filing your consent order only basic assets, income and pensions values are required by the form.
What happens when you file a Consent Order?
Once filed, a Judge will either make the order or ask further questions. Both parties will receive a copy of the order, signed by the Judge and dated once approved. Solicitors fees are typically at least £1000 for this service.
